Terms of Use
Pybites provides a subscription service called the Pybites Platform Premium Subscription (from here on referred to as Premium Subscription) that allows our members to code premium Python exercises in the browser.
These Terms of Use govern your use of our services.
1. Membership (premium users)
Your Premium Subscription membership will continue month-to-month until terminated. To use the Premium Subscription services, you must have Internet access, a functional web browser, and provide a current, valid, accepted payment method. Unless you cancel your membership before your monthly billing date, you authorize PyBites to charge your next month's membership fee using your provided Payment Method. You can find specific details regarding your Premium Subscription membership under "Profile" "Manage subscription".
2. Billing (premium users)
2.1 Billing Cycle
The membership fee for the Premium Subscription service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged monthly to your Payment Method on the calendar day corresponding to the start of your membership. Your payment date may change, for example, if your Payment Method has not successfully settled or if your membership began on a day not contained in a given month.
2.2 Payment Methods
You can change your Payment Method through "Profile" "Manage subscription". If a payment is not successfully settled due to expiration, insufficient funds, or otherwise, and you do not update your Payment Method or cancel your account, we may suspend your access to the service until a valid Payment Method is provided. When you update your Payment Method, you authorize us to continue charging the updated Payment Method, and you remain responsible for any uncollected amounts. Some Payment Methods may incur additional fees, such as foreign transaction fees. Please check with your Payment Method provider for details.
2.3 Cancellation
You can cancel your Premium Subscription membership at any time, and you will continue to have access to the service through the end of your monthly billing period. To the extent permitted by law, payments are non-refundable, and we do not provide refunds or credits for partial-month membership periods or unused "Bites" or content. To cancel, go to "Profile" "Manage subscription".
2.4 Changes to the Price and Service Plans
We may change our service plans and pricing from time to time. Any price changes or changes to our service plans will apply no earlier than 30 days following notice to you.
3. Premium Subscription Service
3.1 Age Requirements
You must be 18 years of age, or the age of majority in your province, territory, or country, to become a member of the Premium Subscription service. Minors may only use the service under the supervision of an adult. One exception to this is minors that use the platform as part of the School Tier, as contracted by their school.
3.2 License and Use Restrictions
The Premium Subscription service and any content viewed through the service are for your personal and non-commercial use only. During your membership, we grant you a limited, non-exclusive, non-transferable license to access and view Premium Subscription content. No other rights, title, or interest are transferred to you. You agree not to use the service for public performances.
3.3 Usage Restrictions
You agree to use the Premium Subscription service in accordance with all applicable laws and not to manipulate the service's content. You agree not to upload, post, email, or otherwise transmit any material designed to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment associated with the service. We may terminate or restrict your use of the service if you violate these Terms or engage in illegal use of the service.
4. Warranties and Limitations on Liability
The Premium Subscription service is provided "as is" without warranties. We do not guarantee uninterrupted or error-free service. You waive all special, indirect, and consequential damages. These terms do not limit any non-waivable warranties or consumer protection rights in your country of residence.
5. Class Action Waiver
WHERE PERMITTED UNDER APPLICABLE LAW, YOU AND PYBITES AGREE TO BRING CLAIMS AGAINST EACH OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Pybites agree otherwise, no court may consolidate more than one person's claims or preside over any form of representative or class proceeding.
6. Miscellaneous
6.1 Survival
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
6.2 Changes to Terms of Use and Assignment
Pybites may change these Terms from time to time, and we will notify you at least 30 days before any changes apply to you. We may assign or transfer our agreement with you, including our rights and obligations, at any time, and you agree to cooperate with us in connection with such an assignment or transfer.
6.3 Electronic Communications
We will send you information related to your account (e.g., payment authorizations, invoices, password changes) electronically, via emails to the email address you provided during registration.
6.4 Pybites Platform Independence
The Pybites Platform and the code within are in no way affiliated with Bob and Julian's employers, both past and present.
